This competition, namely, the “Love Road Trips” is organised by Chevron South Africa (Pty) Ltd (“the Promoter”) and set out below are the terms and conditions of this very Competition. As this Competition will involve and take place on Twitter and Facebook pages, by incorporation, their terms and conditions of use will also apply to this Competition and where conflict between these terms and conditions with those of Facebook or Twitter occur, these Terms and conditions will apply.

  1. The Competition is open to permanent residents and citizens of South Africa except any employee, director, member, partner, agent or consultant or any person directly or indirectly who controls or is controlled by the Promoter and /or immediate family members of any employee, director, member, partner, agent or consultant of or person indirectly or directly in control by the Promoter, its advertising agencies, partners, advisers, dealers, suppliers and/or associated companies.
  2. By entering this Competition, all participants and winners agree to be bound by these rules which will be interpreted by the Promoter, whose decision regarding any dispute will be final and binding. The Promoter reserves the right to amend, modify, change, postpone, suspend or cancel this Competition and any prizes (which have not yet been subject to a draw), or any aspect thereof, without notice at any time, for any reason which the Promoter reasonably deems necessary.
  3. The Promoter may amend these terms and conditions at any time during the Competition, by posting such amendments on winwithcaltex.co.za.
  4. This Competition may be terminated or extended at any time by Chevron. In the event of such termination, all participants agree to waive (give up) any rights they may have in terms of this Competition and acknowledge that they have no recourse of any kind against Chevron or its partners and promotional agents.
  5. This Competition commences at 9am on 24th April 2014 until 12am (midnight) on 3rd May 2014 and takes place online at winwithcaltex.co.za only.
  6. Road trip activities are subject to change in the event of rain or bad weather. Decision will be made by the discretion of the Tour Manager in consultation with the Promoter.
  7. To qualify as an entrant or participant in this Promotional Competition, you must be in possession of a valid South African identification document and live in South Africa (being a resident or a citizen) at the date on which you enter the Competition.

  9. To enter the competition:
    1. Entrants must enter online at winwithcaltex.co.za. Entrants must first select one of two activities displayed on the site they would like the celebrities in the campaign road trip to participate in between daily time slots listed below *weather permitted. Once they have selected an activity, the entrant will need to fill in their name, mobile number and email address and click submit. Any entry not completed in full will be excluded from the daily draws.
    2. Each entrant will only be allowed to enter once per day, determined by a unique email address and mobile number.
      1. All entries received from Thursday 24.04.2014 9am up to 12pm (midday) on Monday 28.04.2014 will make it into the Monday 28.04.2014 draw. Draw will take place 1pm on Monday 28.04.2014 and winners contacted within 24 hours;
      2. All entries received from Monday 28.04.2014 12:01pm, up to 12pm (midday) on Tuesday 29.04.2014 will make it into the Tuesday 29.04.2014 draw. Draw will take place 1pm on Tuesday 29.04.2014 and winners contacted within 24 hours;
      3. All entries received from Tuesday 29.04.2014 12:01pm, up to 12pm (midday) on Wednesday 30.04.2014 will make it into the Wednesday 30.04.2014 draw. Draw will take place 1pm on Wednesday 30.04.2014 and winners contacted within 24 hours;
      4. All entries received from Wednesday 30.04.2014 12:01pm, up to 12pm (midday) on Thursday 1.05.2014 will make it into the Thursday 1.05.2014 draw. Draw will take place 1pm on Thursday 1.05.2014 and winners contacted within 24 hours;
      5. All entries received from Thursday 1.05.2014 12:01pm, up to 12pm (midday) on Friday 2.05.2014 will make it into the Friday 2.05.2014 draw. Draw will take place 1pm on Friday 2.05.2014 and winners contacted within 24 hours;
  10. Winners will be determined by random draw on each of the days listed above by Quirk Cape Town (PTY) Ltd with Chevron’s external auditors/attorneys overseeing the competition/draw. Winners of each of the prize will be notified telephonically. If winners cannot be contacted within 30 working days, the prize will be forfeited and a new winner selected. The judges’ decision is final and no correspondence will be entered into.
  11. Winners agree to supply a valid identification document (SA ID or passport) and proof of address, winning/congratulatory MMS if applicable, and any other validation procedure determined by Chevron, in order to claim a prize. Once verified, winners will be announced immediately on Caltex’s Facebook and Twitter profiles.
  12. The Promoter requires the winners to complete and submit information listed in the disclosure agreement and indemnification to enable the Promoters to ensure compliance with these rules and the Consumer Protection Act 68 of 2008. Should any winner refuse or be unable to comply with this rule for any reason, such winner will be deemed to have rejected the Prizes and it shall revert back to the Promoters.
  13. The Promoters require the winners to be identified, photographed and the photographs may be published in printed media, or to appear on radio and television, when accepting their Prize and/or after having received their Prizes. The winners will be given the opportunity to decline to the publication of their images and to participate in the Promoters’ marketing material in so far as it relates to this promotional competition.
  14. The prize is not transferable and cannot be exchanged for cash.
  15. Any prize not redeemed within a 3-month period after the closing date, will be forfeited.
  16. The prize/s represented by the images in the artwork are for presentation purposes only and variances may occur in the actual prizes awarded. Actual prize colour and exact specifications may differ from that of the image shown herewith.
  17. The Promoter will continuously monitor any irregular behaviour whether it be in entries, voting’s and/or participants details. Consequently, any violation or attempt and/or suspicion of violation or irregular behaviour and/or non-compliance with any of these T’s and C’s will result in the immediate disqualification of the participant.
  18. Entrants indemnify Chevron or the participating Caltex Service Station or Celebrities used or their respective affiliates for any loss or damage that Chevron or the participating Caltex Service Station or their respective affiliates may suffer because of the Entrant’s breach of these terms and conditions. Consequently, the Entrants agree to compensate Chevron or the participating Caltex Service Station or their respective affiliates for any and all loss and damages it suffers (including consequential damages and/ or legal expenses incurred) because of the Entrant’s breach of these terms and conditions. The Entrants also agree to hold Chevron or the participating Caltex Service Station or their respective affiliates harmless for any claim made against Chevron or the participating Caltex Service Station or their respective affiliates by third parties due to the Entrant’s breach of these terms and conditions.
  19. The prize may not be awarded if entry procedures or these terms and conditions have not been adhered to or if Chevron detects and/or suspects any irregularities or fraudulent practices.
  20. All participants indemnify Chevron and participating Caltex Service Stations, Celebrities and any other company associated with the competition and its advertising agencies against any and all claims arising howsoever from their participation in this competition.
  21. All participants further indemnify Chevron, celebrities and participating Caltex Service Stations from any claim should this Competition be called off or extended for any reason whatsoever. Consequently, all participants agree to waive any rights they may have in terms of this Competition and acknowledge that they have no recourse against Chevron, participating Caltex Service Stations or the promotional agents.
  22. If required, as a result of a change in legislation by the Minister of Trade and Industry or the Department of Energy or if the Competition is declared unlawful, Chevron reserves the right to terminate this competition immediately and without notice. In the event of such termination, all participants agree to waive any rights they may have accrued in terms of this Competition and acknowledge that they have no recourse against Chevron or its promotional agents. At the end of the competition all of Chevron’s obligations in regard to the Competition as well as in regard to the prize shall cease to exist.
  23. These terms and conditions are severable and are governed by the laws of the Republic of South Africa.
